- Scope of application
These terms and conditions of sale (“Terms of Sale”) set out the terms and conditions of order, delivery and return of our Products and are applicable without reserve to all sales of Products via our website (the “Site”) to Metropolitan France (including Corsica), the European Union and the rest of the world.
These Terms of sale are available for consultation at any time on the Site and prevail over any other contradictory document.
Paulin, Paulin, Paulin has the right to modify or update these Terms of Sale at any time. However, any order of Products by you will be governed by the terms and conditions available on our site at the time you place the order.
These Terms of Sale are applicable to any purchase on this Site, it being specified that this online store is intended for orders placed on a personal basis by customers, individuals or legal entities, any purchase intended for resale or any other commercial purpose is not authorized. We invite our professional customers to contact us directly at the contact email address.
The customer declares to have read these Terms of Sale before validating his order and irrevocably accepts the Terms of Sale during this validation.
- Products sold
2.1. Presentation and description of the Products
Paulin, Paulin, Paulin presents on the Site several products available for sale, for private customers as well as companies; the main product being the Groovy armchair by Pierre Paulin. Its characteristics consist of a description, photos, sketches, dimensions and technical data sheets for each item.
Paulin, Paulin, Paulin offers two ranges of Groovy chairs:
- The range known as “STANDARD”. It is composed of the Groovy chair that can be ordered in our seven (7) reference colors: white mother of pearl, beige, black, black currant red, black forest green, azure blue, ochre and anodized aluminum legs.
- The “SPECIAL ORDERS”. This is the Groovy chair, the finish of which is executed at the customer’s request. Various colors and treatments for the legs can be made to order.
Paulin, Paulin, Paulin makes every effort to ensure that the descriptions, colors and photographs are as accurate as possible and represent the Products. The images of the Products shown on our Site are provided for illustrative purposes only.
We cannot ensure perfect similarity or guarantee that your computer will display the colors accurately or reflect the colors of the Products. The Products delivered to you may differ slightly from these images. Thus, the descriptions, colors and photographs cannot engage the responsibility of Paulin Paulin and give right to any claim and in particular justify a cancellation of the order or a refusal of delivery.
2.2. Product availability
All orders for Products are subject to availability.
In case of stock shortage or unavailability of the ordered Product, Paulin, Paulin, Paulin undertakes to inform the customer as soon as possible and to specify a period of availability.
The customer will confirm by e-mail his choice, either to wait for the availability of the Product, or to be refunded.
- Product prices and delivery costs
3.1. Sale prices
The sale prices are valid as long as they are displayed on the Site. Prices can be modified at any time without prior notice before the final validation of the order.
The prices of special orders on estimate are transmitted to the customer according to the methods specified in article 4.2.
The prices are expressed in euros, excluding customs and delivery charges:
Prices include VAT applicable on the day of the order for sales to the European Union and no customs duties are applicable,
For sales outside the European Union, prices are invoiced exclusive of VAT and the customer must pay any customs duties, VAT or other taxes due on the Products imported into the country of delivery. The customer is responsible for verifying that the Products ordered can be imported into the country where the Products are to be delivered.
3.2 Delivery costs
The delivery in the standard conditions is invoiced according to the scale below. These costs are indicated before final validation of the order.

- USA: 481 euros
- AUSTRALASIA: 945 euros
- SOUTH AND CENTRAL AMERICA: 845 euros
- Middle East: 787 euros
- EUROPE EEC : 399 euros
- EUROPE OUTSIDE EEC : 499 euros
- France 167: euros
All additional costs related to the rental of elevators, etc. will be charged to the customer and invoiced by the service provider in addition to the selling price and delivery charges.
These prices only regard the shipping and delivery service and do not include potential additional customs rights and taxes; as well as e_CO documents for the countries that need provenance certificate from Chamber of Commerce and Industry.
Before placing an order, it is the customer’s responsibility to make sure that he/she can receive the ordered Products and in particular that they will fit freely in the room of his/her choice (especially stairs and doors), and that there are no other problems that could complicate the delivery or make it impossible.
- Terms of online ordering and payment
4.1. Placing an order for a standard Product
The customer who wishes to place an order on the Site must complete the following steps:

The customer fills in his delivery details if they are different from the billing details
The customer indicates his method of payment

The customer receives by email an acknowledgement of receipt of his order
- Placement of special order on estimate
The customer commits himself to fill in the order form and to give all the information necessary to his identification and to the preparation of a quotation. He must ensure that he provides accurate and complete information. A quotation will then be sent to the customer, indicating the price of the Products, the price of transportation, the time frame for the execution of the offer and the duration of its validity.
The price guaranteed to the customer is the one displayed on the quote at the time of purchase. It is firm and definitive.
The validation of the order is effective only after acceptance of the terms of the quotation by the customer, upon receipt of payment by Paulin, Paulin .
- Order confirmation
The contract will be concluded when a confirmation e-mail is sent. Paulin, Paulin will invoice the chosen payment method after accepting the order.
Any validated order becomes final and entails full acceptance of these Terms of Sale by the customer.
- Refusal of order
Paulin, Paulin, Paulin reserves the right to cancel an order if it is unable to fulfill it. This refusal to accept an order will be confirmed to the customer no later than 72 hours after receipt of the order.
Paulin, Paulin, Paulin also reserves the right to refuse an order or to cancel a purchase for just cause in accordance with article L. 121-1 of the French Consumer Code (unavailability, impossibility of executing the order or the delivery, erroneous sale price, fraudulent use of banking data)
Refusal of an order for a valid reason will only result in the reimbursement of the price of the Products ordered.
- Payment of the order
The payment of the totality of the price is due as of the order and is carried out only on line according to the following methods:

- amount of the delivery charges
- billing address
- delivery address
- payment method and status of payment
- Payment security
Paulin, Paulin, Paulin has chosen efficient and rigorous tools for the security of payment methods. Payment by card is entrusted to the Stripe company. The entry of your credit card number as well as its expiry date and cryptogram is done on a highly secure page directly at Stripe. The Site does not store any card number. Stripe’s payment processing is PCI/DSS certified by Visa and Mastercard. This certification specifies the application of the most stringent security rules to protect Customer credit card data. The customer’s credit card will be debited in euros or in the currency selected when the order is accepted by Stripe. Upon acceptance of the payment, the order is processed for shipment.
Paulin, Paulin, Paulin does not have access to confidential information relating to payment methods. This information concerning orders will therefore not be known or stored by Paulin, Paulin, Paulin and will be requested for any new order. In this respect, Paulin, Paulin, Paulin, cannot be held responsible for damages resulting from the use of electronic means of communication, including damages resulting from a delay in transmission or a failure of communication, or from the interception by third parties of these electronic communications.
5.1. Terms of delivery
The Products are delivered to the address indicated by the customer at the time of ordering and appearing in the confirmation e-mail or on the order form drawn up by Paulin, Paulin, Paulin and validated by the customer in the case of a special order.
An e-mail will be sent to the customer when the order has been shipped.
The order will be executed within the time specified on the quotation and/or upon confirmation of the order by Paulin, Paulin, Paulin and at the latest within thirty (30) days following confirmation of the order for orders to France, subject to the availability of the Product ordered and unless otherwise specifically agreed between the parties.
5.2. Problems during delivery
The customer assumes full responsibility for the Product upon receipt.
The carrier’s delivery slip, dated and signed by the customer upon delivery of the Product, shall constitute proof of delivery.
Upon delivery, the customer shall check the content, the conformity with the delivery note and the Products ordered and the apparent condition of the Products before signing the delivery note.
If any discrepancies are found, the client must either refuse delivery of the Products or notify the carrier in writing, in writing and dated. These reservations must be confirmed with the carrier by registered letter with acknowledgement of receipt within three working days following the delivery of the Products. In the event that the recipient is absent at the time of delivery (or in the event that an incorrect address is given), the carrier will leave a calling card at the delivery address indicated by the client. The Products must be picked up at the address indicated by the carrier
In the event that the Products are not collected within the time limit set by the carrier, they will be returned to Paulin, Paulin, who will refund the Product price, with shipping costs remaining the responsibility of the client. Any new delivery will be charged to the customer.
For deliveries outside the European Union, an invoice will be issued by Paulin, Paulin, Paulin and a copy will accompany the parcel in order to allow the carrier to carry out, on behalf of the customer, the customs clearance formalities.
6) Cancellation, returns and refund policy
In accordance with article L 221-8 of the French Consumer Code, the customer has the right to return the product for exchange or reimbursement within fourteen (14) calendar days from the day following receipt of the order.
If this period expires on a Saturday, a Sunday or a holiday, it is extended until the next working day.

The “SPECIAL ORDERS” made to measure at the express request of the customer are not concerned by this right of return in accordance with Article L 121-20 of the Consumer Code.
The customer will have to specify if he wishes an exchange or a refund.
Within a maximum period of 30 days from the reception of the Product by Paulin, Paulin, the customer will be reimbursed the sums paid according to the same terms as those of his payment.
7) Product guarantee
In order to avoid any inconvenience, the Products are checked by Paulin, Paulin, Paulin before being shipped.
The Products sold online benefit from the legal guarantee of conformity provided by articles L.211-1 to L.212-2 of the Consumer Code as well as the guarantee against hidden defects provided by articles 1641 and following of the Civil Code.

The Product will be exchanged for an identical Product and sent to the customer at Paulin, Paulin, Paulin’s expense, except in case of stock shortage or disappearance of the Product from the proposed range. In the latter case, Paulin, Paulin, Paulin will refund the price of the Product to the customer.
8) Claim process – Non-conformity
Claims for non-conformity of the Product delivered with the order must be made in writing directly to Paulin, Paulin, Paulin immediately upon receipt. The customer must keep the packaging and the delivery slip.
In the event of an error on the Product, the customer undertakes to return the said Product or Products concerned within seven (7) days of receipt to Paulin, Paulin, Paulin on condition that they are returned without deterioration of their packaging, in their original condition and packaging with the accompanying documents.
Upon receipt of the Product in due form, Paulin, Paulin, Paulin will return, at its expense, the Product initially ordered.
9) Intellectual property
Paulin, Paulin, Paulin is the holder or assignee of all intellectual property rights relating to the logos, brands, texts, photographs and images appearing on the Site and the Site’s catalog.
Consequently, any reproduction, use, exploitation, partial or total distribution, on any medium whatsoever, of the elements making up the Site and the catalog, their use as well as their provision to third parties or their placing on line are formally prohibited without the express and prior agreement of Paulin, Paulin. Failure to do so constitutes an infringement and/or a tort and may be prosecuted.
10) Personal data

11) Force majeure
The performance by Paulin, Paulin, Paulin of all or part of its obligations will be suspended in the event of the occurrence of a fortuitous event outside our control or force majeure which would hinder or delay its performance. 12) Dispute / Jurisdiction
The fact that any clause of these Terms of Sale becomes null, void, unlawful or unenforceable because of a law, a regulation or following a final decision of a competent court, will not call into question the validity, the legality, the applicability of the remaining provisions will remain in full force and effect.
These Terms of Sale are governed by French law and only the French version of the Terms of Sale will be valid in case of dispute.
In the event of a dispute that cannot be settled amicably, the courts of the registered office of Paulin, Paulin, Paulin shall have exclusive jurisdiction (PARIS), unless the client’s local consumer law considers that its courts have exclusive jurisdiction pursuant to public order.
